Searching Indianapolis DUI Records Online

The primary tool for searching Indianapolis DUI and OWI records is MyCase.in.gov. This free public portal covers all Marion County courts. You can search by a person's full name or by case number. The system shows the charges filed, hearing dates, court orders, and the final outcome of each case. Most new filings appear within a few days of being entered into the court system.

When searching Indianapolis OWI records, use both "OWI" and "DUI" as search terms. Indiana law uses OWI, but many people and older records still use DUI. If a search turns up nothing, try alternate spellings of the name or contact the Marion County Clerk's office directly. Records that have been expunged or sealed will not appear in the public portal.

The Marion County Court Records page at marioncountycourt.org/court-records provides additional guidance on searching and requesting records. The city's online records request system at indy.gov is another resource for certified copies of Indianapolis OWI case documents.

Indianapolis OWI Cases and Indiana Law

Indiana's OWI statute at IC 9-30-5 governs all OWI cases in Indianapolis. The law defines OWI as operating a vehicle while intoxicated by alcohol, a controlled substance, or any other substance. The charge level depends on the BAC reading and the person's prior record.

A first OWI with BAC between .08% and .14% is a Class C misdemeanor in Indiana. If BAC is .15% or above on a first offense, the charge becomes a Class A misdemeanor. A second OWI within 7 years of a prior conviction is a Level 6 felony. Indianapolis, as the state's most populous city, sees a high volume of OWI cases each year, and the Marion County courts process them on a regular schedule. Cases involving serious injury are Level 5 felonies. OWI causing death can be a Level 4 or Level 3 felony.

The Indianapolis Metropolitan Police Department (IMPD) handles OWI arrests throughout the city. The Indiana State Police also operates in the Marion County area and can make OWI arrests on state highways. Both agencies submit arrest records to the Marion County courts, and those case files become part of the public court record once charges are filed.

Indianapolis DUI Record Expungement

Indiana's expungement law at IC 35-38-9 applies to OWI convictions in Indianapolis and Marion County. For a misdemeanor OWI, the waiting period is 5 years from the conviction date. A Level 6 felony OWI requires an 8-year wait. All court fines and fees must be fully paid before filing a petition.

In Indianapolis, expungement petitions are filed at the Community Justice Campus, 675 Justice Way, Indianapolis, IN 46203. The court reviews the petition and may schedule a hearing. If the petition is approved, the Indianapolis OWI record is sealed from the public MyCase portal. Law enforcement and some state agencies can still see sealed records. Expungement does not automatically fix any driver's license suspension. Separate steps are needed with the Indiana BMV for license reinstatement.

Not every Indianapolis OWI conviction qualifies for expungement. Cases involving serious injury or death are generally not eligible. An attorney or the Indiana Self-Service Legal Center at in.gov/courts/selfservice can help determine if a specific case qualifies.

BMV Driver Records for Indianapolis OWI Convictions

OWI convictions from Indianapolis cases are sent to the Indiana BMV and appear on the driver record. There are two ways to get a driver record. The free Viewable Driver Record is available online at in.gov/bmv/resources/driver-record. The Official Driver Record costs $4 and is the certified version that courts, attorneys, and insurance companies rely on.

Indianapolis residents who want to review their own OWI history can use the free viewable record. If a certified record is needed for a legal or administrative purpose, order the Official Driver Record. There can be a delay of a few weeks between a court's OWI conviction judgment and when the BMV updates the driver record database. If the record does not show yet, wait a short time and check again.
