New Albany sits along the Ohio River, directly across from Louisville, Kentucky. That means some people who live or work in the Louisville metro area get OWI charges in Floyd County. If you are searching records for someone who commuted across the river, check Floyd County courts rather than Kentucky courts.

OWI Laws That Apply to New Albany
Indiana does not use the term DUI. The official charge is OWI, which stands for Operating While Intoxicated. The law is found in Indiana Code 9-30-5. It covers alcohol, controlled substances, and other intoxicants.
A standard first OWI with a blood alcohol content of .08 or higher is a Class C misdemeanor. If the BAC reaches .15 or if someone else was put at risk, the charge goes up to Class A misdemeanor. A prior OWI conviction within the last seven years turns a new charge into a Level 6 felony. Felony OWI carries heavier fines, longer possible jail time, and a longer license suspension.
OWI cases in Indiana often come with added penalties like mandatory alcohol evaluation, possible treatment programs, SR-22 insurance, and ignition interlock requirements. The court in New Albany follows these same state rules.
New Albany OWI Record Expungement
Indiana law allows some OWI convictions to be expunged under Indiana Code 35-38-9. Expungement seals the court record from most public searches. Not all OWI cases qualify, and you must meet a waiting period before you can file.
For a misdemeanor OWI, the wait is five years from the date of conviction. For a Level 6 felony OWI, it is eight years. You also must not have any new convictions during that time. The petition gets filed with the same Floyd County court that handled the original case.
Expungement does not erase the BMV record or restore driving privileges on its own. You still have to deal with those steps separately. The Indiana Legal Services website can help explain the process if you cannot afford a lawyer.
Note: Even after expungement, some agencies like law enforcement can still see sealed records in certain situations.
BMV Records for New Albany OWI Cases
The Indiana Bureau of Motor Vehicles keeps a separate driver record that shows OWI convictions, license suspensions, and points. This is not the same as the court record. You can get a free Viewable Driver Record at in.gov/bmv/resources/driver-record. This version shows your own record.
An Official Driver Record costs $4 and is what courts, attorneys, and insurance companies typically use. You can order it through the BMV portal or by visiting a BMV branch. New Albany does not have its own BMV branch inside the city, but the nearest ones are in the surrounding Floyd County area.
OWI convictions stay on the Indiana driver record for a long time. Insurance companies look at these records when setting rates. A New Albany OWI conviction can raise your premiums significantly, even if no one was hurt.
The Indiana MyCase system gives free public access to court case records statewide, including Floyd County OWI filings.
