Indiana OWI Law Applied to Pulaski County Cases
Indiana law charges impaired driving as OWI — operating while intoxicated — under IC 9-30-5. A first OWI below .15% BAC is a Class C misdemeanor. At or above .15%, it becomes a Class A misdemeanor. A second OWI within seven years of the first becomes a Level 6 felony. Each of these levels results in different penalties and different case file content in Pulaski County courts.
US 35 runs north-south through Pulaski County and sees regular Indiana State Police patrol activity. ISP troopers and the Pulaski County Sheriff both make OWI arrests in the county. Cases from either agency are filed at the Pulaski County Circuit Court in Winamac. The arresting agency is documented in the probable cause affidavit that becomes part of the case record, but it does not change the charging statute or the court that handles the case.

MyCase covers all Indiana county courts including Pulaski County Circuit Court, and the results include case type, charge details, hearing dates, and final dispositions for OWI filings.
License Suspensions and Driver Records
An OWI conviction in Pulaski County leads to a BMV license suspension under IC 9-30-6. Suspension length varies by offense level and prior OWI history. Chemical test refusal triggers a separate administrative suspension that the BMV applies even before the criminal case is resolved. Both suspensions can apply at the same time, and a driver may face a longer total suspension period than either would produce alone.
Driver records from the BMV online portal cost $4 per request. The Official Driver Record shows the current license status, any active suspension, reinstatement requirements, and habitual traffic violator status if applicable under IC 9-30-9. Drivers with HTV suspensions can petition for specialized driving privileges under IC 9-30-10 in Pulaski County Circuit Court. If granted, that order becomes part of the public case file and is visible in MyCase.
Expungement Under IC 35-38-9
Indiana's Second Chance Law at IC 35-38-9 allows people with qualifying OWI convictions to petition Pulaski County Circuit Court to seal their record. Misdemeanor OWI requires a five-year wait from conviction. Level 6 felony OWI requires eight years. Cases involving death or serious bodily injury are excluded.
After expungement is granted, the case is removed from public searches including MyCase. If a Pulaski County OWI case you know existed does not appear in a search, it may have been expunged. Law enforcement retains access to expunged records. Instructions and forms are at in.gov/courts/selfservice. Indiana Legal Services may be able to help qualifying residents with the petition process at no cost.
What the Court Record Shows
A Pulaski County OWI case file contains the charging document, the arresting officer's probable cause affidavit, any motions filed by defense or prosecution, and the final sentencing order. The charging document names the specific statute — IC 9-30-5 — and states the factual basis for the charge, including the alleged BAC if known. The sentencing order specifies jail time, fine amount, probation length, required alcohol education, and license suspension terms ordered by the court.
MyCase shows a summary of these events in docket form. Each entry is dated and describes what happened — hearing held, motion filed, order entered. To see the actual text of any document, you must visit the Pulaski County Courthouse or submit a written records request to the Clerk at 112 E Main St, Winamac. For active cases, docket entries in MyCase update regularly and are usually sufficient to track what is happening in the case.
